Terms of Service

These are the terms for using Peakgenic (peakgenic.com). By creating an account or using the service, you agree to the following.

1. Acceptance of these terms

By accessing or using Peakgenic, you confirm you are an adult (18 or older) and can form a binding contract, and that you agree to be bound by these Terms and our Privacy Policy. If you don't agree, don't use the service.

2. What the service is

Peakgenic is described on our homepage; in short: Peakgenic maps your proportions, then builds the rest around you: personal tips, a skin card and routine, and clothing and style tips. Peakgenic works from one photo, so lighting, angle and expression affect results. Not medical advice: for skin or hair concerns, talk to a doctor.

3. Accounts

You're responsible for keeping access to your account secure and for all activity that happens under it. Sign-in is passwordless (magic link to your email) — keep your email account secure, since it's the key to your Peakgenic account. Tell us right away at [email protected] if you suspect unauthorized access.

4. Billing & credits

One-time purchases grant a fixed number of credits that don't expire. Credits are non-transferable and have no cash value outside the service.

Final prices and terms are shown before you buy. If a charge fails or is disputed, we may suspend access until it's resolved. If you believe you were charged in error, email [email protected] and we'll make it right.

5. Acceptable use

You agree not to:

• Use the service for anything illegal, fraudulent, or harmful to others.
• Attempt to reverse-engineer, scrape at scale, or interfere with the service's normal operation.
• Submit photos of anyone other than yourself, or a photo of a person under 18. Peakgenic is for adults and for photos of yourself only.
• Submit content you don't have the right to submit, or that infringes someone else's intellectual property or privacy.
• Resell or sublicense the service without our written permission.
• Use the service to generate content designed to deceive, defraud, or impersonate a real person or organization without disclosure.

We may suspend or terminate accounts that violate this section, with or without notice, at our discretion.

6. Your content and data

You retain ownership of information you submit. When you analyse a photo you confirm you have the right to use it; you agree to the processing described in the consent line by tapping "I agree" before upload. Landmarks and measurements are computed on our own server; the photo (low detail) and the measurements are shared only with Microsoft Azure, our AI processor, to write your plan, tips, skin and style advice, and, when available, style previews. We do not store the photo, never use it for training and never sell it; we keep the report derived from it until you delete it. See the Privacy Policy for details.

7. Intellectual property

Peakgenic, its logo, and its software are our property (or licensed to us) and protected by intellectual-property law. These Terms don't grant you any right to our trademarks, branding, or underlying code beyond using the service as intended.

8. Third-party services

We rely on Microsoft Azure AI (plan, advice and, when available, style preview generation), Amazon SES (email), Stripe and Apple (payments) and our own hosting. The Privacy Policy lists what each receives.

9. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the service will be uninterrupted, error-free, or that its output will meet your specific requirements. 10. Limitation of liability

To the maximum extent permitted by law, Peakgenic and its operators won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the one year before the claim arose.

11. Indemnification

You agree to indemnify and hold Peakgenic harmless from any claim, loss, or damage (including reasonable legal fees) arising from your misuse of the service or your violation of these Terms.

12. Termination

You can stop using Peakgenic at any time, and you can ask us to delete your account by emailing [email protected]. We may suspend or terminate your access if you violate these Terms, or discontinue the service entirely with reasonable notice where practical. Sections that by their nature should survive termination (billing already owed, liability limits, indemnification) continue to apply.

13. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which Peakgenic's operator is established, without regard to conflict-of-law principles. Any dispute that can't be resolved informally should first be raised with us at [email protected] — we'd rather fix a problem than litigate it.

14. Changes to these terms

We may update these Terms as Peakgenic evolves. The version at peakgenic.com/terms always governs, and we'll update the "Last updated" date above when we make a change. Continuing to use the service after a change means you accept the updated Terms.
